San Francisco 49ers quarterback Colin Kaepernick is being investigated in a sexual assault case in Miami, according to a report from TMZ.

At this time, Kaepernick has not been charged with a crime. The report states that the incident allegedly took place at the Viceroy Hotel earlier this month. The Sacramento Bee is reporting, based on the Miami PD police report, that the incident took place at the apartment of Ricardo Lockette, a Seattle Seahawks receiver.

TMZ also published a photo of Kaepernick at the hotel on April 5, with the quarterback posing with a big group near a swimming pool.

The 49ers released a statement to TMZ after the report went public.

“The 49ers organization is aware of the recent media report regarding Colin Kaepernick and is in the process of gathering the pertinent facts.”
