With 10 days to go before a critical appearance in Manhattan criminal court, the attorney for Plaxico Burress is working feverishly behind the scenes to find a negotiated settlement that would allow Burress to play football in 2009 -- either by reaching a plea deal with minimal jail time or by postponing a possible trial until after the 2009 NFL season with the hopes of playing this fall, a source with knowledge of the case said Friday.

"Right now, everything is speculation, but I will know more on Monday," Burress' lawyer, Benjamin Brafman, said Friday.

After months of discussions with the Manhattan district attorney's office, Brafman thus far has failed to reach a plea agreement on the felony weapons charges against Burress, primarily because the former New York Giants wide receiver has been adamant about avoiding jail time, according to sources with knowledge of the case.

Any jail time no doubt would be followed up by a visit to NFL commissioner Roger Goodell, who could impose a penalty, including a suspension, under the league's personal conduct policy.

One way to avoid all that, at least this year, is to try to get the trial postponed to early 2010, allowing Burress to perhaps play football in the coming season.

If Burress isn't suspended by Goodell, what example and precedent is that gonna set?!

It would be hilarious if Burress gets the trial postponed, signs with a team for 09, and then Goodell suspends him for part or all of the season...my guess is that Goodell is waiting to see if when his trial is before he imposes any punishment.

What's the purpose of pushing it to 2010? He'll only have to face the consequences then. Is Plax trying to play just one more year before he resigns himself to spending years of his prime in jail?

You see this every now and again where an athlete is facing serious legal trouble and his only concern is playing time. These people are so disconnected from reality its sickening.

Plax either:
a) doesn't realize fully the trouble he is in,
b) has not learned anything from this experience,
c) does not care,
d) all the above

Goodell, if he is able to, should bar Plax and teams from pursuing any options until this dispute is settled.

Plax has made a huge mistake by letting it be known that he is terrified of going to jail. Nobody wants to go to jail but to reveal that your deathly afraid of it is a whole other matter. The judges , prosecutor, (possible future cell mates) all know he is terrified. I think Paul P is right in Plax being disconnected with reality. It's as though he thinks if He plays in 09 that this is going away. Much better to deal with this right now and get it over with. Do the time if any, deal with the suspension, grow up, and move forward.
