Jamar Nesbit sues NFL over StarCaps
The StarCaps case has been a legal pain in the hiney for the NFL, one that will not go away until after the 2010 season.
Now, it’s taken another turn with Jamar Nesbit, a former offensive lineman for the New Orleans Saints, suing the league for fraud and negligence.
Brian Murphy of the St. Paul Pioneer Press reports that Nesbit filed suit in Manhattan district court, accusing the test administrators of bending rules for “at least eight players” who tested positive for bumetanide, the banned substance found in StarCaps.
Nesbit tested positive and served a four-game suspension. Minnesota Vikings defensive tackles Pat Williams and Kevin Williams and Saints defensive end Will Smith are still waiting the outcome of their cases in court. Their suspensions remain on hold.
Nesbit wants the league to pay him for the four weeks he was suspended and did not receive pay. He is also seeking punitive damages from the NFL. It’s a whole new can of worms for the league, and you can see why Nesbit feels he has been wronged, especially if the Williamses ultimately prevail in court.
