Dallas Cowboys safety C.J. Spillman, currently being investigated for an alleged sexual assault in Texas last month, was also investigated for an alleged attempted rape and not charged with a crime last December in California while playing for the San Francisco 49ers, according to the New York Daily News.

Per the report, a massage therapist accused Spillman of trying to rape her at her studio. Spillman told police it was consensual. No charges were filed.

The woman said that Spillman groped her and tried to rip her pants off and pinned her to the ground and tried to force her to perform oral sex on him.

Spillman was never arrested or charged with a crime.

"The San Francisco 49ers are aware that the Santa Clara Police Department made contact with C.J. Spillman in December 2013 and that he was neither arrested nor charged," the team said in a statement.

Spillman continues to play for the Cowboys while he's being investigated for an alleged rape at a hotel.

"Yeah, no comment on anything where there hasn't been a charge or an arrest made," Cowboys coach Jason Garrett said. "I'll leave it at that."
